1. Introductory provisions
Price list
These Terms and Conditions of advertising on Golfproperty.eu (hereinafter referred to as the “Terms and Conditions”) regulate the rights and obligations of the operator and the users in the provision and use of services on the Golfproperty.eu portal.
The operator of the Golfproperty.eu portal (hereinafter referred to as the “Portal”) and the provider of services is the company DITY EU s.r.o., with its registered office at Klincová 35, 821 08 Bratislava, registered in the Commercial Register of the District Court Bratislava I, Section Sro, Insert No.: 130108/B, ID No.: 51814536 (hereinafter referred to as the “Operator”). The Service means the online real estate advertising services provided by the Operator to mediate offers and inquiries between the Users of the Portal (hereinafter referred to as the “Service”).
A Portal User is any natural or legal person who accesses the Portal and uses the Services provided by the Operator on the Portal (hereinafter referred to as “User” or “Users”). The Portal Services may only be used by natural persons who are 18 years of age or older at the time of entering into a contract with the Operator.
Advertisers are entitled to add advertisements to the Portal, the subject of which is an offer to sell, buy or lease real estate or parts thereof, to which the advertisers exercise ownership or other rights that entitle them to dispose of the advertised real estate within the scope of the advertised offer.
Real estate means land or a building (usually a house, flat, commercial premises, other buildings) connected to the ground by a solid foundation. The operator also allows advertisers to advertise the offer of real estate projects of buildings in various stages of project implementation.
An interested party is a natural or legal person who is interested in buying or renting real estate and for this purpose uses the Portal to search for advertisements
The competent authority for the control of the provision of services regulated by these Terms and Conditions and the related Services is the Slovak Trade Inspection, SOI Inspectorate for the Bratislava Region, Prievozská 32, P.O. Box 5,820 07 Bratislava 27 (hereinafter referred to as “SOI”).
2. Basic conditions of providing the Portal services
The use of the Portal’s services is possible only after the User has agreed to these terms and conditions of advertising on the Portal.
The Operator of the Portal provides advertising services to the Users of the Portal for a fee, except for special events. The legal relationship between the User (advertiser, interested party) and the Operator is established by concluding an advertising contract or payment by credit card with an advertising order by delivering a binding advertising order to the Operator, agreed by both parties,
Upon conclusion of the contract, the Operator shall be obliged to publish the ordered advertisement and the User shall be obliged to pay the agreed price.
The purpose of the advertising services is to publish the content of the offer and demand for the purchase, sale or lease of real estate.
The Operator of the Portal is not responsible for the content and truthfulness of the advertisement, nor for the transactions concluded on the basis of the advertised offers. All liability arising from the concluded deals shall be borne by the Users who are parties to the contractual relationship in the event of concluding a deal.
The Operator shall not be liable for the misuse of the data published in the advertised offers of advertisers by third parties.
The Operator reserves the right to publish advertisements added by Users also on social media (fcb, instagram, youtube) related to the golfproperty.eu website – this way of disseminating advertisements is not charged separately to the User.
The User who advertises on the Portal guarantees that he advertises the offer of a property owned by him or a property to which he exercises other rights that entitle him to dispose of the advertised property within the scope of the advertised offer.
In case of suspicion that the offer is not an offer of a property owned by the advertiser or a property to which he exercises other rights that entitle him to dispose of the advertised property, the Operator has the right to request a document proving the legal relationship of the owner or the owner of the advertised property, as the case may be. If the Operator does not receive this information, the Operator has the right to delete these advertisements or cancel the User’s access without notice and the User loses the right to a refund of the advertising fee already paid.
3. Advertisement price and payment terms
The services of the Portal for advertisers are chargeable (except for special events).
The price of advertising for advertisers is chargeable. Advertisement price is: 10€/1 property with validity for 90 days from the date of payment. By paying for the advertisement posting service, the User agrees to the terms and conditions for posting the advertisement. In the event of a change in the price for the publication of the advertisement, this change will not affect advertisements for which the price for the publication of the advertisement has already been paid at the time of the price increase.
An invoice for the advertisement will be sent to the user’s email within 5 days of payment. By making payment for the publication of the advertisement by credit card or by transfer to the Operator’s account, the User agrees to the commencement of the provision of the service; by giving this consent, the User loses the right to withdraw from the contract. The User hereby declares that he/she has been informed that by giving consent to the commencement of the provision of the advertising service on the Portal, he/she loses the right to withdraw from the contract.
4. Registration of the User
Only a registered (logged in) user may advertise. Registration is mandatory due to the contact details of the advertiser that will be displayed for advertisements.
5. Obligations of Users
The User is fully responsible for the content of his/her own published offers (advertisements), including text and photographs. When adding an offer, the User is obliged to ensure that its content complies with the legislative standards of the Slovak Republic, to indicate the actual location in which the subject of the offer is located and to indicate in the “Price” field the desired market price, or to indicate “Price by agreement”.
The user is not entitled to publish the same offer several times. The user is not entitled to publish offers for real estate which, for whatever reason, are not intended for sale, lease, sublease, exchange or auction at the time of publication. The User is obliged to remove such offers without delay.
6. Liability for damages
The User is aware that he/she uses the services of the Portal solely at his/her own risk. The Operator is not responsible for the actions of the Users of the Portal Services, nor for the manner in which they use the Portal Services. The Operator is not liable for damages incurred by Users or third parties directly, indirectly or accidentally as a result of or in connection with the use of the Portal services. The Operator shall not be liable for damages caused to Users or third parties as a result of a technical failure of the services of the Portal or in direct or indirect connection with this fact. The Operator of the Portal is not responsible for the content added to the Portal by its Users, in particular, it is not responsible for the truthfulness of advertising and misleading and comparative advertising published by the User. In the event that the Operator becomes aware that the content added to the Portal by its Users is contrary to generally binding legislation, good morals or these Terms and Conditions, it is entitled to block or remove such content in the manner set out in these Terms and Conditions, even without prior notice or invitation. The right to withdraw from the User’s contract is not affected by this provision. The Operator is not liable for the continued functionality of the Portal, its error-free operation and security. The Operator is entitled to temporarily suspend the operation of the Portal without prior notice and without giving any reason. The Operator shall not be liable for any damage that may be caused to the User in connection with the use of the services of the Portal, caused in particular by its non-functionality, errors, the activities of other Users or for other reasons. 7. Transitional and final provisions
These Terms and Conditions of advertising on the Portal come into force and effect on 1.8.2020. For objective reasons, the Operator is entitled to unilaterally change the advertising prices for advertisers determined in accordance with the Price List without prior notice and at the same time inform the advertisers of the change made. The advertiser is entitled to express his/her disagreement with the price change without undue delay and to negotiate the terms of further continuation or termination of mutual obligations. If the advertiser does not notify his/her disagreement with the change according to this clause, the changes shall be deemed to have taken effect against him/her. In the event that the User does not agree to a change in the Terms and Conditions that is in the nature of a substantial unilateral change in the terms and conditions of the Contract, the User shall be entitled to withdraw from the Contract with the Operator without penalty in the part and to the extent to which the change in the Terms and Conditions relates to the Service provided to the User on the Portal. The Terms and Conditions shall be valid throughout the validity and effectiveness of the legal relationship between the User and the Operator, as well as after its termination, until the full settlement of all claims arising therefrom.
